$425,000 Settlement Won for Man with Injured Spine
August 23, 2018
My client was a strong, healthy man, who had served in the military and owned a house painting business. He had a wonderful family, too, with his loving wife and two growing children. But everything about my client’s life changed on August 9, 2013. He was visiting his father and helping him with the construction of a pole barn in his backyard. As they were working on the attic, my client stepped on a piece of plywood that had not been properly secured, and he fell to the floor below, hitting his head and landing on his side. An ambulance was called, and hospital staff determined that he had suffered a major spinal cord injury. My client had a pacemaker installed and was under constant supervision, not being released home until nearly two years after the accident occurred. Today, he is paralyzed from the shoulders down and relies on the care of his wife and a nurse for the majority of the day. Because his father owned the unsafe property where the accident occurred (and didn’t warn my client of the hidden potential danger), his insurance was liable for the incident. When the company refused to meet their responsibility, my client sought out our help. My fellow attorneys and I worked together to build a strong case in his support so as to obtain the compensation he deserved. Ultimately, our efforts won him $425,000, and we negotiated a $3,000,000 United States Department of Veterans Affairs lien to a minimal level.
